URGENT MUST READ: New Regulations on Vape Shipments

The end of an era has arrived. Specifically, the era of having your favorite vape products shipped directly to your door. On December 27th, 2020, something called the PACT Act was signed. This PACT act, known as Prevent All Cigarette Trafficking, effectively ends the shipment of all vape products, whether they contain nicotine or not, to your home.

WHY IS THIS HAPPENING?

Vaping has received a lot of backlash since the JUUL panic, where young teens were acquiring the devices illegally and oftentimes adding their own blend of THC and Vitamin E acetate to the prefilled pods. This resulted in many users getting severely ill, with several users losing their life! Vaping as a whole was condemned, with many states getting rid of flavored e-liquids, raising the minimum age from 18 to 21, and implementing a strict tobacco tax to all vape products. But that still wasn’t enough. Former President Donnald Trump signed the PACT act in his few remaining days of office, in an attempt to reign in the panic associated with teens vaping. However, the PACT act did not specify vaping products as “tobacco products.”

WHEN WILL THIS HAPPEN?

The massive bill was several thousand pages long, with a provision on page 5,136, that bans the USPS from shipping any vape related products to anyone, regardless of age. The loose wording failed to include any products including nicotine, which was quickly corrected to include any electronic device that aids in the nicotine delivery system. While shipping vape and nicotine products to minors has always been prohibited, the new PACT act has caused all of the major couriers to set dates on when they will no longer be shipping vape products to their customers. FedEx will halt shipment on March 1st, UPS will halt shipments on April 5th, and USPS will halt shipment on April 26th.

OTHER REQUIREMENTS

In addition to not being able to use these three major couriers, all vape shipments will be required to be sent out via an expensive alternative service that requires an immediate age verification (21+) on arrival. Every online website will be forced to file monthly reports to state reps and the federal government, with details about the customer, order, amounts, and frequency of the orders. Taxes will be implemented on every vape product, and will be documented and filed along with every order.

This amendment to include all vape products in the PACT Act puts a huge strain on small business and huge brand name companies as well. Consumers will no longer be able to enjoy the luxury of having their favorite vape products shipped to their homes via well-known couriers. Online websites have had the ability to offer lower prices due to not being an actual brick-and-mortar site, along with being able to store thousands of products in warehouses for future sales. Some vapers may quit vaping entirely due to being unable to be home for deliveries, while others may decide to go back to smoking. And all this in the name of “protecting minors from vaping.”

When something is made more difficult to acquire, the black market surges to provide the banned items. Ask your state representative what will happen when people are forced to find other means to acquire their beloved vape juice...is an underground market of vape shipments something the government wants to be responsible for? Argue that with this new law, the mandate to “stay safe and only leave your house if absolutely necessary” becomes more difficult if vapers are no longer able to receive shipments of their favorite vape products. A simple package of vape supplies being eliminated now forces the millions of vapers to leave their homes to acquire vape products, increasing the possibility of exposure to the Coronavirus, and possibly risking the lives of all they come into contact with.

This supposedly health-centric law now jeopardizes the safety and well-being of all vapers who have previously enjoyed home deliveries. How does eliminating home delivery of vape shipments urge people to stop smoking and stay safe at the same time? Vaping has helped millions of former smokers kick the habit, either by nic-salts, freebase nicotine, disposable vapes, and pod devices. Insurance companies have seen a decline in health-related claims, thanks to cigarettes becoming less and less popular. Vapers have formed strong bonds and social circles with other vapers that is vital to their well-being.

The world will always fear what they do not understand. Vaping comes with a steep learning curve that is easily aided with more knowledgeable users.
