New York Gov. Expedites Ban on Flavored Vape Products

Last week, President Trump announced plans to ban flavored vape products at the federal level. In a tweet over the weekend, Trump seemed to clarify his position that he wasn't against vaping, but did not want to make sure it was "safe for all,":

Even if Trump did pass such a bill, it would have to get approved by the Senate and Congress before getting passed into law. This process will typically take 12 to 24 months, which means there isn't an immediate threat to flavored vape products at the federal level; however, lawmakers are pushing for flavor bans at the state level and these can take effect much quicker.

In the most recent event, New York Governor Cuomo has taken executive action to ban flavored vape products across the state. The Consumer Advocates for Smoke-Free Alternatives Association (CASAA) reports that the bill is being fast-tracked by Cuomo and includes the following initiatives:

  • “State Police and Department of Health (DOH) partner to immediately ramp up enforcement efforts against retailers who sell to underage youth – possibilities of criminal penalties.
  • “Advances legislation to eliminate deceptive marketing of e-cigarettes to children and underage youth.
  • “DOH Commissioner, Dr. Zucker, will hold an emergency meeting with PHHPC to ban e-cigarette flavors.”

If passed, this bill could produce an immediate 90-day ban on the sale of flavored vape products and enforcement of the law could begin as early October 4th of this year. 

While this bill will not put an end to New York's teen vaping issue, it will have a catastrophic impact on the vape industry in New York. 

Consumers will be cut off from the products that helped them to stop smoking and NY vape shop owners would be forced to close their doors due to the decline in sales.

This will have not only a negative financial impact for thousands of New York residents, but it could also lead to an increased number of teen cigarette smoking, which has decreased by a whopping 28.4% over the last year alone. Vaping has been a thorn in the side of big tobacco corporations, but with the crushing blow this ban would deliver to the e-cigarette industry in New York, big tobacco could begin to regain their influence. 

We cannot allow this ban to happen in New York or in any other state. Vaping has changed the lives of millions of Americans, with flavors being one of the strongest contributing factors. If lawmakers pass these harmful bans on flavored vape products, it will reverse all the progress that has been made by this industry.

Flavored vape juice should not get baned and you should be 18 or older to buy vapes, vape juice, cigarettes and tobacco and 21 for alcohol there is nothing wrong with vaping it’s better then smoking cigarettes or smoking cigars and drinking and you get that yummy taste in your mouth do to the flavors. I strongerly believe that flavor vape juice should not be band.

I enjoy vaping I would probably have to resort to smoking if the ban went into effect. Also the affect on my health by vaping isn’t as bad as smoking I can tell just the difference in my walking and exercise!

Though I am fully for the crack down on illegal cartridges being made that are the reason people are getting sick, not flavored vape juice, I think it is an extremely uneducated decision to be making by pushing for a ban on flavored vape juice. I don’t see flavored cigarettes such as Marlboro Smooths being restricted. Flavored vape juices helped me quit smoking. I was coughing and hacking stuff up, I couldn’t breathe. Even now after 2 and a half years of vaping, being in the same vehicle as someone who is smoking a cigarette with the window open, the smoke seems to sufficate me and I can’t breathe. There is no craving there what so ever for a cigarette. I’ve even gotten upset and bought a pack of cigarettes, I couldn’t even finish the first one. It made me gag and want to throw up. Vaping has gotten my mom and my boyfriend to quit smoking and quit stinking like and ashtray. My mom smoked on and off for 20 years. My boyfriend smoked for 4 before we met, and together we quit and went to vaping instead.

It’s plain to see this is funded by the tobacco industry. They’re losing millions since vaping helped so many to quit smoking. I’ll buy a DIY kit and make my own juice before I go back to smoking.

This ban is terrible. Vaping flavors that are just tobacco flavored will just make me want to smoke again. I’m sure many feel the same way.

Instead of taking away the flavors that so many of us ADULT vapors enjoy, crack down on the sellers and marketing of vaping products, the same way you cracked down on minors buying alcohol and cigarettes! Go after and fine establishments selling to minors, go after the marketing campaigns, there are other options you can do rather than banning a product that has helped thousands of adult smokers to quit, granted vaping I am sure has it’s own risks but as with smoking it was our choice to start smoking, but now here is a product that truly has helped us stop smoking, don’t ban this because children are getting their hands on it in mass numbers, yes I do agree that the industry appears to have targeted young people but that is where the crack down needs to start just as the government cracked down on the marketing and sales of cigarettes and alcohol to minors, they didn’t ban it, well with the exception of prohibition and we all no how well that worked for you, they fined the hell out of vendors and marketing! That is where you need to focus your efforts, yes young people will certainly be able to somehow get their hands on these products, just as they still are able to get cigarettes and alcohol but those numbers will be the minority. BANNING the making of the product will open another more horrid door, that is the underground market, where people will buy the flavors they enjoy but will not have a clue who is making, what is in it etc, I’m positive that will be much worse for kids as well as adults.

This is so ridiculous!! I have been vaping for 8 years or more with no problems what so ever. There is no way the flavors have anything todo with the illness. With the millions of people who vape an have been for many years with no ill effects. I think the people with the all of a sudden health issues are doing more than a little vaping. Even if you ban the flavors they can easily be made at home or obtained in the black market witch would cause sickness an probably death from people trying to mix up their own with no idea what they are doing or the company’s will find a way around the band an sell the flavors separate from the pure Nicotine. With high does nicotine being more available an People being their own chemist will not be good at all. It’s been Legal for at least 9 years or more an only a handful of people getting sick there has to be more to the story. I think there should be in lab Studies be for you start pulling it from the market. What about cigarettes they cause cancer an lung disease but I don’t see ya’ll taking them off the market. Witch is crazy to me. So go ahead an take away the our products to we can go back to smoking an die anyways.
